Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of services provided by BTBIZ, LLC and its affiliates (“BTBIZ”) and is incorporated by reference into any agreement between BTBIZ and its customers (“Customer”).

Scope of Services

The term “Services” refers to all products and services ordered by the Customer using a BTBIZ account or provided by BTBIZ on a trial basis or free of charge. These typically include connectivity services that link BTBIZ platforms to telecommunications networks over the Internet.

Prohibited Uses

Customers and their end users are strictly prohibited from using the Services in the following ways:

Illegal or Harmful Activities: Engaging in illegal, fraudulent, abusive, or harmful activities, or interfering with BTBIZ’s operations or other customers.

Security Violations: Attempting to bypass or disable security features, or engaging in activity that poses a security risk to BTBIZ or its users.

Reverse Engineering: Analyzing the Services to uncover vulnerabilities or filtering methods.

Denial-of-Service (DoS): Launching or facilitating DoS attacks or actions that impact the availability or reliability of the Services.

Unwanted Communication: Repeated or mass messaging or calling that could lead to complaints.

Malware Transmission: Distributing viruses, worms, spyware, or other malicious content.

Regulatory Violations: Violating any applicable laws or regulations, including but not limited to:
CAN-SPAM Act
Telephone Consumer Protection Act (TCPA)
Do-Not-Call regulations
Data protection or privacy laws

Spam or Harassment: Sending unsolicited, unwanted, or harassing messages, including calls, SMS, MMS, voicemails, or faxes.

Data Harvesting: Collecting personal information (e.g., phone numbers or emails) without consent.

Law Enforcement Inquiries: Using the Services in ways that trigger inquiries or requests from regulatory authorities.

Intellectual Property Infringement: Transmitting content that violates the rights of third parties.

Offensive Content: Sharing content that is defamatory, discriminatory, obscene, hateful, or otherwise objectionable.

Identity Misrepresentation: Using forged identities, caller IDs, email headers, or misleading information.

Industry Standard Violations: Misuse that results in complaints from telecom providers or violations of industry standards set by CTIA, MMA, or others.

Telecom Provider Complaints: Use that violates carrier rules or guidelines and leads to complaints.

Call Quality Abuse: Patterns like:

Excessive unanswered outbound calls

Low average call durations (under 12 seconds)

Short-duration calls that appear suspicious or automated

General Use Guidelines

Sensitive Data
: BTBIZ Services are not intended for storing, transmitting, or processing sensitive data (e.g., health, financial, or government data). Customers are responsible for applying appropriate safeguards if they choose to handle such data using the Services. BTBIZ assumes no liability for the handling of Sensitive Data.

 Enforcement & Violations

Violating this AUP may lead to civil or criminal liability. BTBIZ may, at its sole discretion:
Suspend or terminate the Customer’s access to the Services
Impose applicable charges, termination fees, or penalties
Investigate suspected violations and cooperate with law enforcement or regulatory agencies
Pursue legal action to prevent violations or recover damages
Any breach of this AUP by the Customer or third parties acting on the Customer’s behalf will be considered a material violation of the applicable service agreement.
No Waiver: Failure to enforce this AUP in a specific instance does not constitute a waiver of BTBIZ’s rights.

Limitation of Liability

BTBIZ shall not be liable for any direct, indirect, incidental, punitive, or consequential damages—including lost profits, business interruption, or loss of data—arising from actions taken under this AUP, even if BTBIZ has been advised of the possibility of such damages. This limitation is in addition to any limitations outlined in the main customer agreement and applies whether claims are based in contract, tort, or other legal theories.

Updates to this Policy
Notice of Changes: BTBIZ may revise this AUP by providing written notice to the Customer at least fifteen (15) days prior to the effective date via email to the account owner.
Customer Acceptance: Continued use of the Services after the update effective date will be deemed acceptance of the new terms. If the Customer disagrees with the updates, they must stop using the Services.
Legal or Carrier Exceptions: BTBIZ may not be able to provide notice when updates are required due to law or telecom carrier mandates.
